Question i said something that was taken racial and i want to know if i said sorry soon as i said it and everything does this follow under the 1st amendment i really don't want to lose my job over a joke
Answer Noah,
There is a distinction between the freedom to say what you want in public places and in your own home and the restrictions on behavior at work places of private employment.
A lot really depends upon the circumstances and details as to the incident itself. Please understand that many employers frown upon jokes and such that smack of intolerance. It is possible that you could lose your job if your employer has a policy in place that requires zero tolerance. My suggestion is to write down your version of the incident and include your apology and the nature of your intent when you said it.
This will preserve the facts and show that you are serious about not offending anyone and wanting to keep your job. Hopefully at most your supervisor will question you about the incident and you can state that you are embarrassed and remorseful, but it is best to be prepared.
