1st Amendment and Free Speech - Defamation or slander? or just forget it

Question
Hello my name is Phil and over the last several weeks Ive been dealing with a situation involving a former friend/bandmate/business associate of mine.As well as with my fiancee. There were some situations involving my fiancee and myself dating to July 19th of this year she took it upon herself to email my former friend and inquire about these situations, this is not what the problem is just stating some background information to help give a better picture of the situation. The problem is what happened afterwards the two of them had some heated exchanges on AOL instant messenger and he has now posted these private conversations interspersed with his own sarcastic observations in a myspace blog. As well as some negative assessments of me being on welfare and how calling my fiancee a woman is an insult to womankind and things of a very private nature and I am wondering what my best course of action is?

Answer
Mr. Berger,

I'm sorry but you've really hit on a free speech area that I just don't have much expertise in. Possibly your local ACLU--or their web-site, www.aclu.org, might help, but I'm not even sure of that. My personal, nonexpert, advice is to not have much more to do with your forer friend and to ignore what's being said or posted--but I know that's easier said than done.

Good luck to you in all this.

Regards,

Ed Buckner
