QuestionHi Don, so I sent the Judge a letter when he denied my permit for Omission of Fact because I forgot that misdemeanor charge back in 1979. I told him it wasn't done intentionally and I assume he is stating I have to re-apply. He sends me a letter saying the Court denied the application based on the background check which revealed that I did not list the arrest and upon recommendation of the County Sheriff's department. He states upon further investigation the court also discovered that another judge permanently revoked my pistol permit by Order dated 5/6/2002. This Court again denies your pistol permit application. If you have other questions or concerns, I suggest you consult with an attorney.....this judge doesn't get it. I am sure the Sheriff's department said I didn't disclose the arrest so they recommend denying it. I sent in with my original application a copy of my old license, my CRD and a letter stating it was revoked due to the felony...I love how he says "upon further investigation"...I told him. So he never did answer the question. So I think I will re-apply, list arrests accurately, and also not forget to answer the question have you had an application denied...I'll put in this recent denial so he can't try to get me denied again. I shouldn't have to hire an attorney for this. Do you think I should point out that I have my VA CCW?
AnswerYes, you should add a letter explaining that you have your VA firearm permit and point out the federal firearm law 18. U.S.C 921 (a)(20) as well. That pertains to those who have their rights restored after felony convictions. Every state except for a few like Virginia wants you to beleive that after a felony you no longer can have a firearm. Obviously that's not true. NYS Dept. of Parole and Probation don't even know the federal firearm codes. That is a shame and they call themselves law enforcement. Yhis is a way to discourage you from getting your firearm permit.

I'm still fighting to get my Florida Firearm Permit back another state that doesn't follow federal laws correctly. So watch out for them too. They gave me my permit then revoked it 10 months later.
