QUESTION: Well, I received a denial letter from the County Judge. He denied it based on Omission of Fact. Sheriffs dept recommended denial because I forgot to put a misdemeanor arrest on my application from 1979. It was a harassment charge and I was given a conditional discharge at the time. I don't even remember that. I have written the Judge indicating such and wondering why the officer did not mention that to me while doing the phone interview. So I can only assume I will have to pay another $125.00 and
re-apply. I received my VA in less than 30 days. They should put a X through those I love NY signs.

ANSWER: That sucks!!!  Don't give up, if that is the only reason they turned you down then you still have a chance.  I agree with you when you say take down the signs.  I moved to Virginia out of NY. Now I'm a visitor in NY.  It feels great to be able to haul my firearm with me when I leave the house everyday.  Maybe I'll go for my NY permit and see if I get approved.  I have VA, and FL. now.  I don't know if I ever told you but I'm in the same situation as you are.  One NY non-violent felony with restoration of rights from NY and Executive Clemency in Virginia.  So I traveled that road you are on. And I have served 7 years in the Military (ACTIVE), been a Virginia and Pa. Corrections Officer and serving in the U.S Army Reserve now.  I still don't get a break in NY. Plus the Judge at my sentencing released me with no probation just a guilty plea no prison time.

QUESTION: I just sent the Florida stuff out, so that might be a bit. I also am sending out my paperwork for a Certificate of Good Conduct. I am asking specifically to resore my firearms priviledge. So maybe I will just wait and see if they give me the Good Conduct letter (I'm a Banker) and then I will bombard the County with both the CRD and the CGC. Thanks Again!

If you did not do State time or State Parole you will not get a Certificate of Good Conduct.  I applied 3 months ago they visited my home in NYC for an interview then called me a month later saying that a Certificate of Relief was all I can get being that I was never in a State facility or on State Parole.  It was a waste of time and ordering my transcripts from the IRS.  You may be able to have the State Courts put firearm restoration on your CRD.  It's going to be a struggle.  Did you ever get a chance to read Federal Law 18. U.S.C 921 (a)(20).  This law will give you an idea of why you are correct in fighting for your second amendment rights after you have been convicted and had your rights restored.  Look it up online.  I can fax you a copy also.  It's a very important piece of information a lot of Law Enforcement people don't know these laws.  NYC Dept of Probation still go by the old Federal Firearm Laws that prohibited any convicted felon from carrying a firearm unless both state and Federal Gov't gave them Restoration of Firearm rights.
