Question
Don- Awhile back I asked about when I am filling out the application for a Gun you stated..."On the Federal application for gun purchase your answer for have you ever been convicted of a felony is NO because you have restoration of rights through your certificate of relief which for the purpose of purchasing a firearm ONLY you are allowed to answer no to that question unless your certificate specifically says you can't own, purchase or transport a firearm."...so when I actually fill out the NYS Permit application again...should I say no or yes to the question of being convicted of a felony? Thanks

Answer
THE STATE APPLICATION AND THE BATFE FEDERAL FIREARM PURCHASE APPLICATION ARE TWO DIFFERENT THINGS.  ON THE FIREARM PURCHASE APPLICATION IT SPECIFICALLY TELL YOU THAT IF YOU HAVE A PARDON, EXPUNGEMENT, FULL RESTORATION OF RIGHTS OR IF YOUR CONVICTION WAS SET ASIDE THEN YOU ARE TO PUT NO ON THEIR APPLICATION.  THE NYS FIREARM PERMIT APPLICATION IS DIFFERENT YOU MUST PUT YES ON THAT.

GOOD LUCK WITH THAT
