QuestionI have been arrested for narcotics offense 4 times. 1. 11352(A) HS-Transport/Sell Narc/Cntl Sub. Dispo:Rel/Det only/Evidence insuff 2. 11351(A) HS-Poss/Purchase For Sale Narc/Cntrl Sub-
3. 11350(A) HS-Possess Narc control sub. 4. 11351.5 HS-Poss/Purchase Cocaine Base For/Sale Second and third time recieved suspended sentence /drug crt-defferred judgement. These two case were concurrent. On the fourth i was convicted of a felony. sentenced 120 days county jail and 36 months formal probation. All cases were in a short period of time. From 09/2000-03/2001. Fullfilled my obligation as ordered by the court. I requested A Personal Firearms Eligibilty Check from DOJ/Firearms Division. I am currently ineligible to Purchase or Possess. I like to find the specific reason why i am not legible and for how long, or if i will ever be able to have these rights restored, I like to be able to Hunt Deer. Thanks for your help.
AnswerThere is no time period for how long after a felony will you be restricted from firearms, You are restricted forever unless you have full restoration of rights no restrictions, Pardon, Expungement, or your conviction was set aside. The Federal Government makes the firearm law(BATFE aka ATF). States are allowed to add their own to the federal laws but not supersede. Read Federal Firearm code 18. U.S.C 921 (a)(20).
You will have to find out how you can get your rights restored in the state of California. Some states do it through an executive clemency board or the Dept. of Parole/ Probation.
