2nd Amendment and Right to Bear Arms/NCIS Check

Question
Hi Don - I am still working on re-submitting my application to NYS for my CCW. I have the VA non-resident and have applied for the FL non-resident. I have my CRD from NYS with no restrictions. If I were to go and purchase a rifle here in NYS, does the NCIS check automatically deny or put a hold on it? How do they know I have the CRD? I think you said on the application to put NO in response to the question have you been convicted of a felony because my rights have been restored. Is the check the same on long guns compared to hand guns? Thanks.

Answer
Yes, your answer would be no for the purpose of the application but you must read the reverse side of the application for yourself.  As far as long guns are concerned you don't need a NICS check.  When you purchase a firearm in NY you will need a CCW, When you do the NICS check you will be delayed for a day maybe hours and they will check the records and see you have a CCW and restoration of rights.  If for some reason you are denied you have to appeal with a copy of your restoration of rights and your CCW.

Good Luck
