QuestionQUESTION: Back in 1974-75 I was convicted of Breaking & Entering. Now, more than 30 years later I am trying to get a gun permit. I live in NJ, what are my chances?
ANSWER: NJ is like NY when it comes to felons with firearms you will never get it. You will have to spend thousands on a lawyer first before they will even consider it. You can try to get NJ restoration of rights with no restrictions. Check with the Parole/Probation Dept. for an application. That still want secure a NJ firearm permit.

QUESTION: I don't believe B&E is a felony. I did have to "serve" 6 months however. If B&E is not a felony do I have a chance?

ANSWER: You have to let me know what they charged you with I can't tell you. If you have a felony you have to get restoration of rights with no restrictions. NJ probably won't give you restoration of firearms rights but if they do you are good to go. Remember NJ is very strict when it comes to firearms especially if you have been convicted of a felony. Pennsylvania would be an example of a state that will give restoration of firearm rights very easily. NY and NJ are very strict.

QUESTION: Yes, in Hackensack. It was a long time ago, but if I remember correctly, the charges were Breaking & Entering and recieving stolen property. There were other charges but I plea bargined them away. I am 99% sure it was not a felony charge. Thanks for trying to help!

AnswerOK Wayne you need to get your fingerprints ran through the Federal database to see if you have a Felony or not. Or return to the courts you was convicted in and get a disposition letter that will tell you the charges and the conviction.
