2nd Amendment and Right to Bear Arms/Is Restoration Good In Other States

QuestionQUESTION: In 1971 I received a Restoration of Civil Rights in the State of Alabama. I now live in Texas. Can I possess a firearm in Texas or other states with my restoration. I didn't know until recently that this certificate restored my right to bear arms. I have not hunted in in 35 years. Maybe I can now. One more question, to get a carry permit, do I need to present the certificate of restoration?

ANSWER: Yes you can, however you must apply and receive a firearm permit first. Most states require those who have full restoration of rights to have a permit before they can possess a firearm. You may also need the firearm permit in order to pass the NICS check without having to appeal it first. Your cetificate must have no restrictions meaning it must not say you can't own, possess or transport any firearms or weapons.
What I would do is apply for Virginia and/or a Florida non-resident permit first. These two states definately respect full restoration of rights. I beleive they both have reciprocity in Texas also. This would help you with receiving your Texas permit.

QUESTION: Thank you for your fast answer to my question. If I may ask, why should I get a Virginia or Florida non-resident license first? Is it going to be difficult to get a license in Texas? I have no restrictions on my restoration of rights.

AnswerTexas may acknowledge your Certificate or they may not for firearm restoration. If you had a FL or VA permit that will show them you are a proven rehabilitated law abidding citizen. You can call the agency in charge of Texas firearm permits and ask them do they accept an Alabama Restoration of Rights Certificate. They should be able to give you a straight answer.
