2nd Amendment and Right to Bear Arms - Ohio restored rights proof?

Expert: Don Reed - 3/2/2008

Question
I was convicted in Ohio 20 years ago of breaking&entering.
I've read as much as possible. Doesn't appear Ohio placed any firearms restrictions on me. I was on probation not parole for three years but never received any paperwork. It appears by law Ohio has restored all my rights after completing probation. What paper work would I need to appeal a NICS denial? Would getting a copy of the journal entry of my probation release be enough? I can't get a certificate of rehabilitation from the parole board saying rights were restord cause I was never on parole. I'm stumped. Any help is appreciated. Thank you

Answer
You need to get a Certificate of Relief from Disabilities, Restoration of Rights or Executive Clemency wichever one your state offers.  Your automatic restoration of rights are only for voting. Firearm rights must be granted through a certificate.  Read the Federal Laws then your local State laws.  When you receive your Certificate as long as it doesn't state you can't carry, transport or purchase a firearm then you are cleared through Federal Laws.  Then you can send the paperwork to NICS for appeal.  You will always need a firearm permit/license to carry purchase or transport a weapon.

Good Luck
