Question
In 1988 I received an Absolute Discharge from prison after serving 5 years for violating A.R.S. 13-604 with the use of a deadly weapon. I recently applied to have all rights restored. Only my right to vote is restored. It has been 20 years since my discharge. Is it impossible for me to EVER have my 2nd Amendment restored and for the courts to vacate the judgment of guilt?

Answer
Hello Julie,

The courts do not have the power to vacate a judgement of guilt unless you appealed and won your appeal.  What you may be looking for is a pardon or expungement which both are very hard to get especially when you have a violent felony.  I'm assuming this is a state conviction and not a Federal.  Most times you will have an interview with a Sr. Parole Officer or whoever is in charge in your state for Restoration of Rights when you have a Violent Felony.  If you received restoration of rights and it does not state you can't purchase, transport or own a weapon and you have the rights to hold public office then your rights are fully restored.  If you have any further questions feel free to follow up if I can help I will.

Good Luck
