2nd Amendment and Right to Bear Arms/criminal possession of a firearm
Expert: n/a - 8/4/2008
QuestionI live in kansas and 10 years ago, I was convicted of a misdemeanor possession of marijuana...i bought a 9mm 4 years ago and was approved by NICS. Well in October of 2007, the police arrested me for criminal possession of a firearm. Eventho they dropped all charges and returned my gun...a lawyer said that it is illegal for anyone in kansas to own a gun if they have had a drug conviction of any type. But I am not sure of that..could you help me on that subject please? Thank you!
AnswerI don't know about Kansas law but you are not banned from firearms according to the federal government. You must have been convicted of a felony or a misdemeanor of Domestic Violence in order to be banned from firearms. Although you are not a convicted felon you should get yourself a firearm permit so this won't happen again. You should also apply for restoration of rights or executive clemency for your conviction.
Good Luck
