Question
I live in upstate NY. I have an 03' FFL. Can I purchase handguns that are curio and relics, from outside NY State? If so, how do I go about getting them put on my handgun license which is required by the State? Will my County clerk accept me as the seller and buyer?

Answer
Yes, you may bring guns into the state with your 03 FFL and add them to your state pistol license. However, unless your County Clerk has done this before, he or she may not have a procedure in place and may not know it is legal or how to handle it.

Some years ago, I obtained an opinion from the state Division of Criminal Justice Services that such transfers were legal under NYS law. I then worked with the Nassau County PD to create a procedure. In Nassau, the procedure enacted was that the 03 Licensee purchased the handgun from the out of state seller, and had the seller fax or mail him a bill of sale. The 03 Licensee took the bill of sale and a copy of his FFL to the license division and obtained a purchase coupon, listing himself as the seller (as an 03 FFL) and also himself as the buyer (as a NYS pistol licensee). Once the purchase authorization was granted, the 03 Licensee contacted the out of state seller and had him ship the pistol.

I suggest you contact your County Clerk in advance and discuss the procedures that he or she wants to follow. But the bottom line is that it is legal to do such transactions, and other counties are doing it as well.
