2nd Amendment and Right to Bear Arms/federal conviction / right to bear arms
Expert: n/a - 2/23/2009
QuestionQUESTION: I was charged in federal court in 1984, non-violent 1st degree felony for possession of a precursor chemical. I have had no arrests since then. I have had my right to vote and hold certain offices, restored. Do I need to make a seperate application to have my right to bear arms returned, or is it included in the restoration of my civil rights? If not included, where do I petition for the return of the right to bear arms? Thank you for your time.
ANSWER: Sorry, only BATFE has the right to restore firearm rights to federal felons. As of now you can't get your firearm rights restored because of their budget. You must apply and receive a Presidential Pardon.

QUESTION: Is their a form or a web site I can go to,to continue this search? I am sure a presidential pardon is out of the question. So, in essence, you are telling me I can never carry a firearm without further arrest?
AnswerYes, You are restricted from owning a firearm unless you get a presidential pardon. No other way for federal convictions as of now. State, local convictions can receive full restoration of rights but federal convictions have no way of receiving BATFE assistance and the State can't give anyone with a federal conviction
restoration of firearm rights.
