QUESTION: I plead guilty to the Class 1A misdemeanor of assault by pointing a gun in NC in 1986. I was young and stupid and had I known then what I know now I would have hired a lawyer and fought it as self defense. I now live in FL and went through the CCW class while filling out the application it asked if I had ever been convicted of a violent misdemeanor and if so to provide a copy of the official court record with my application. I sent away for the court record and noticed on the  record that due to this being a Class 1A misdemeanor that in NC I can't own a firearm in NC.

Can I legally own a firearm in FL now? I have purchased 2 firearms in the past both at gun stores and I passed the background check without any problem. Also if I'm able to own a firearm will I be able to get my CCW in FL.

ANSWER: Florida has different firearm laws than NC.  FL does not restrict anyone with a misdemeanor from possessing a firearm unless it was domestic violence.  You must first get a firearm permit before you can carry legally in FL.

QUESTION: Don, thanks for the reply. You are correct and after calling numerous numbers and being tranfered to about 50 different people I got the right dept. and found out that the "Not Own A Weapon" was only a condition during my 3 year unsup. probation and that now I can legally own a firearm even in N.C.

Do you know if this past conviction will have a negative impact on me getting my CCW in FL? The only thing the application package states is that 3 years must have passed since the time of the offense.

Florida is a shall issue state so if you qualify they will issue you the permit.  Next to Virginia, Florida is the easiest state to get a firearm permit.  If you are looking to get a non-resident permit that has reciprocity in NC I suggest the Viginia non-resident permit.  It's fast easy to get and you can get your class from any state.  Just go online to Viginia State Police website and download the application and get your fingerprnts done at any sheriff or police Dept.
