Question6 months ago, I plead guilty to a 5th degree domestic assault charge not knowing it would affect my gun rights. Yesterday, I tried to purchase a new rifle, and was rejected when the clerk called in the NICS. I am a minnesota resident, and thought only felonies were taken into consideration. What can you tell me about this, and what does it mean for the firearms I currently own?
AnswerYou are restricted from any type of firearms. If you was just convicted of domestic violence I'm sure you have a restraining order against you also. You won't be able to apply for restoration of rights until the restraining order is null and void and til a certain time period passes. You must check to see what is the time frame in your state usually 5 years before you can apply for restoration of rights. You have to have someone put your weapons up for sale if you are in posession of any. If for some reason your home is searched that will be a felony charge and definate prison time. A domestic violence conviction is a firearm restriction law passed by the Federal Government. It is a serious offense these days although it's just a misdemeanor.
