QuestionIn 1997 I was convicted of domestic battery in Indiana. From what I've read, after 5 years if there has been no further convictions one can have their right to carry restored. It has been 12 years and I've had no further convictions. What I don't know is how to go about getting it restored. Is there a form I can fill out and if so where do I get one? Or is it better to have a lawyer handle this?
AnswerYou will have to return to the courts where you was convicted and start the process for FULL restoration of rights with NO restrictions. Some states use an Executive Clemency Board, Dept. of Parole/Probation, Dept. of Corections/Rehabilition and Some use a Dept. of Pardons and Parole. Which ever one your state use you will have to fill out an application for restoration of rights. If you were on probation check with the Probation Dept. If Paroled check the Parole Dept. They are going to request information on what positive things you have been doing after your conviction. Restoration of firearm rights are not always awarded after the application process. Many times they will attempt to restrict your firearm rights especially with a violent and Domestic offense.
