2nd Amendment and Right to Bear Arms/restoring of rights after M1 conviction in PA
Expert: n/a - 4/15/2009
QuestionQUESTION: 12 years ago I was plead guilty to an M1. I didn't think it kept me from owning a firearm in PA, but PA does not allow me to because it had a possible sentence of more than 2 years.
To make it worse, I tried to purchase a firearm and didn't realize I had to answer yes to a question because of the possible sentence and was arrested for felony unsworn falsifications. I was acquitted.
I have read your answers to questions about PA misdemeanors, specifically about restoring of rights.
My questions are: What is the probability of getting rights restored? Is it a difficult task? Will restoring enable a concealed carry permit?
Thank you.
ANSWER: First I don't know what M1 is all I need to know is if you have a felony or a misdemeanor. To get rights restored in Pa. through the court of common pleas you will need a Lawyer. Or you can go online google Pa. restoration of rights and download an application and mail it in. If M1 is Murder like it is in NY you can forget about a firearm ever...

QUESTION: I am sorry, M1 is a misdemeanor of the first class. I am in misdemeanor punishable by more than 2 years category.
I understand i need to apply for a restoration of rights, but i was wondering if you have ever heard of it being pulled off in Pennsylvania.
If it is, would that make me eligible for a ccw?
ANSWER: CCW's are at the discretion of the issuing agency only they could answer that question. There is no law on Concealed Carry Permits as far as issuing them. Pennsylvania says they are a shall issue state but they restrict people from CCW's when they have non-violent misdemeanors that a may issue state. The only misdemeanor the federal government says will restrict you is domestic violence. That is why Pa. is so difficult, they say you can get restoration of rights through the court of common pleas and that will secure your CCW I have yet to hear anyone on this site confirm that.
Good Luck

QUESTION: Thank you again.
Have you heard of anyone getting their actual rights restored, not just in getting the ccw?
AnswerYes me, I would not answer questions on anything I didn't have experience or education on. There are several people I guided on this site that have actually been through the process and received their restoration of rights. I just don't know of anyone in Pennsylvania. You have to get out there and demand in a nice way that your state guide you in the proper way to getting your righs restored. If you sit around and wait for them or anyone else to tell you what to do you won't succeed at restoring your rights. Even lawyers don't know the process in the states they are licensed in. Just go to the court of common pleas and request how you can get restoration of rights. Or google Pa. restoration of rights there is a website there where you can download an application and mail it in to the address on the form.
