2nd Amendment and Right to Bear Arms/Can I own a Fire Arms again?
Expert: n/a - 5/7/2009
QuestionI was convicted of Domestic Violence 2 years ago and unfortunately lost my right to own a gun. My girlfriend actually lied about the whole thing. Although no weapon of any such was used and no violence occurred I still lost this right. It's sad that anyone can file a claim on someone else accusing them of domestic violence and in an effort to protect themselves. There was a restraining order. Is there a way to re-instate my 2nd amendment rights? can I go huntung? I plan to petitioning the domestic violence law allowing the reinstatement of the 2nd amendment because for my EX found it too easy to accuse me right away. This happened in Orange County, NY Thanks in advance~
AnswerIf you have a domestic violence conviction and/or a restraining order you are restricted from firearms, so no you can't go hunting. You can't even be caught in the vicinity of a firearm unless you are visiting the Police Department. NY is probably the second most strict State in this Country when it comes to firearms. You can return to the courts where you was convicted and apply for a Certificate of Relief from disability. You only lost your firearm rights because it was a misdemeanor correct. So your application will be a simple yes or no.
Good Luck
