2nd Amendment and Right to Bear Arms/Re obtaining a pistol permit in NY State
Expert: n/a - 7/23/2009
QuestionHi:
I had my pistol permit revoked in Westchester County for sending out nude photos of an ex to her co workers. To make a long story short Judge Susan Cacace deemed me unfit to posses a pistol permit. My past history is impeccable with the exception of an arrest three years ago on a harassment charge that was later dismissed by the Honorable Judge Ponzini.
Back in March of this year I got denied when I reapplied from scratch by judge Jeffrey A Cohen for the same reasons that Judge Cacace gave. I have contacted the head judge in this district, Francis Nicolai, and to no avail. He claims he does not get involved in these matters.
The alleged victime worked for LA's Sheriff's department and they came here along with local police with a search warrent and an order for my arrest. Everyone I spoke with knows there was judicial misconduct from Nicolas Maselli who issued the search and arrest warrnts, to Judge's Cacace and Cohen. Had the alleged victim not worked for a law enforcement agency, none of this would have happened.
I have since contacted the Commission on Judicial Conduct, back in early April and am awaiting a reply as to whether they are going to investigate this matter.
No attorney is willing to touch this issue. Why I don't know. I am licensed to carry in almost thirty states, through Florida as a non resident but am deemed a social misfit in my home state. Is there any guidance you could afford me in this matter?
Thanks in advance,
Santino
AnswerYou may have to change counties no Judge will override the decision of their co-worker on these issues. CCW permits in NY are still issued at the Judges discretion as well as revoked at their discretion. When you are a CCW holder you must make better decisions. I'm afraid you may have to switch States if possible.
Good Luck
