2nd Amendment and Right to Bear Arms/Purchasing a gun

Question
Dan,

My wife is a convicted felon in florida. We are currently living in Alabama where she is on probation. I recently tried to buy a gun and was turned down, but I already here's a gun prior to marrying her. Am I unable to purchase a gun being married to her?

Answer
Shane,

Thanks for inquiring.

If you cleared for purchase of a firearm before you married her, and have no record since, you should clear the NICS background check. Being married to a convicted felon is not one of the questions on form 4473, so she should not pose any problems other than she cannot get her hands on one of your guns or both of you will be in trouble.

Best regards,

Dan
