QUESTION: I received a Relief of Civil Disabilities from the state of New York. I was approved by the FDLE here in Florida to purchase a handgun. I want to get my CCW permit here in Florida but am running into a discrepancy between the FDLE which is Florida's first point of contact which performs the instant background checks, and the Department of Agriculture which issues the CCW permits. The FDLE requires that box b be checked under question 11 on my Certificate of Relief while the Department of Agriculture requires box c to be checked. The FDLE would not have approved me for my firearm purchase had box C been checked. How can I get my CCW permit? I have done some research and Federal Law (ATF) does not require that firearms rights be written on the Certificate of Relief,but they require either box a or b be checked.This does not make any sense to me, I can purchase a handgun, but not receive a CCW? I thought Florida was a "Shall Issue" state? Any suggestions? Thanks in advance

ANSWER: In Florida the Dept. of Agriculture approves or disapproves all firearm permits.  I'm from NYC and now live in Florida I know plenty of people with a NYS Certificate of Relief and a Florida Firearm License with box C checked.  NYS Probation will only check box C, from now on you have to state why you want the CRD on the application.  You can also apply for Florida Executive Clemency that will clear you in the State of Florida but only if you have an address in Florida.  It's Gauranteed, you will just have to wait about 2 years to receive your documents.  You can also apply for a Virginia non resident Firearm Permit they accept NYS Certificate of Relief even with box C checked as long as it does not state you can't possess, purchase or carry a firearm.

QUESTION: Thanks for the reply. I obtained my Certificate of relief about a month ago, I wonder why box c wasn't checked? I know that I would not have been approved by the FDLE to purchase a handgun had box c been checked, I called them and asked before I purchased my handgun, they said specifically that box b had to be checked.
I am going to apply for a Virginia non-resident CCW permit like you have suggested. I take it you meant Virginia will take a certificate of relief even if box b is checked so long  as it does not specifically state that I CANNOT own or possess firearms? Thanks again. I will let you know how things go.

O.K I misunderstood, actually having block A or B checked is better than having C checked, read the back of the Certificate.  If you had C checked a statement of why you need the certificate would follow meaning the job listed will be the only job or license that has to acknowledge the certificate.  Box A means you received the certificate at your probation sentencing from the Judge and none of your rights are lost, B would mean your rights are restored fully except to hold public office.  But you can go online at Virginia State Police and call them direct ask them if they will acknowledge your CRD.  Fax them a copy if you have to.  You would need a firearm training class to get their firearm permit or a military DD-214.
