Topic: 2nd Amendment and Right to Bear Arms

Expert: Don Reed
Date: 3/15/2008
Subject: Restoration of Handgun Rights

Question
Reed: I was convicted 22 years ago of the felony charge homicide by motor vehicle while driving under the influence in Pennsylvania. Is there any way for me to get my right to own a handgun restored here in PA? Thanks!

Answer
No,  Homicide is one of those convictions that restoration of rights will not cover for firearm restoration.  I believe the Federal Law prohibits anyone with a homicide conviction from ever having firearm rights restored unless a full pardon or expungement was given.  And in order to get one of the two for homicide you would have to prove you was innocent.

Good Luck
