Question QUESTION: My wife came home drunk and starting an argument. She was being loud and told me to throw her her purse which I did. She did not like the way I threw it and called the police. I went to jail. It occured at 2a.m. on a worknight and I did not want her behavior to wake up our kindergarten child. The charge was filed battery against a spouse rather than the domestic violence formal. Lawyer says take the battery against spouse charge. My rifle was confiscated by police. My question is; what is my best course of action that I may obtain an expungement in the future. I have no record and 17 years toward a military reserve retirement. Thanks.
ANSWER: I would consult another lawyer.
You will lose your gun rights with a conviction for this.

QUESTION: how would a deferred adjudication leading to dismissal affect my firearms rights. The stipulations are 1 year probation, much anger management therapy, forfeiture of my rifle (which was "liberated" by arresting officer)court fees,etc. If no law violations during this time case is dismissed. However, I am required to enter plea of "guilty" or "no contest" to the charge of battery against spouse to be eligible for the deferred adjudication leading to the dismissal. Thanks.
