my husband called me a moucher and has also told me he would kill me he has grab my hand and told me he would break it and just the other day he said he would break my finger .we had dont nothing but fussed off and on since we got married.and he smart off to my kids how can i be sure that he is abusive he has been married 5 times
Yes this is abuse if your husband has initiated physical contact and has threatened harm he's abusing you. Get out of this before it gets worse. I wouldnt stay with an abusive prick because your kids don't need to grow up with a poor example of a parent like that.

I can answer just about anything on abusive relationships, but I can't give legal advice on how to get out of one that's something you need to speak with an attorney or a counselor trained and certified to deal with domestic violence issues to get resources in pursuing any/all legal recourse(s).
Experience
I have been in abusive relationships and I have shared my experience in helping others to get out of these types of relationships. I was in two abusive relationships one lasting nearly 2 years and the other for 5 years.
