Question
Can a salaried exempt emp call in on a day (Mon), work 35 hrs for the remainder of that week, chose NOT to get paid for the 8hrs as sick or ph time, just no pay, but put in for 35hrs of pay for actual hrs worked?  Current policy in practice is an employee (Ex or NE)is out of the office for under 4hrs, they may make up that time within that same work week.  But she says she is not 'making up' time, she is saying she is just not taking pay for it, but wants to be recognized with pay for her 35 hrs she did work.  Seems that it is intermingling Exempt and Nonexempt rules?

Answer
Exempt employees need to be paid for all time worked in a week. If they are gone for a whole day for personal reasons and have no personal or vaction time than they can be docked. If they have personal or vacation time they must be paid with the Personal or vacation time.

This is under the Federal Fair Labor Standards Act.
