Question
what is the length of time an employee has to be away from home to determine if withholding in another state needs to be applied?

Answer
Withholding is not determined by the amount of time the employee is away from home.

State withholding is determined by where the work is performed. Whichever state the work is performed that is where the withholding needs to take place. There are some states that have reciprocal agreements with other states so you would need to look at that. What a reciprocal agreement means is that if two states have a reciprocal agreement, an employee is only subject to the income tax in the state where he lives.

For example : There is a reciprocal agreement between Illinois, Iowa, Kentucky, Michigan, and Wisconsin.

If you live in Illinois and work in Iowa you file in Illinois because there is a reciprocal agreement.

If you live in Illinois and work in Missouri you file taxes in Illinois and you file a non resident form for Missouri because there is no reciprocal agreement.
