Question
If an employee works 4 days at 8 hrs. and 1 day is paid sick time do overtime rates apply to hours worked on Saturday, or would it be straight time do to the fact that they really only worked 32 hours.

Answer
Generally, overtime is time worked in excess of 40 hours per week. I am not sure about a day being treated as sick time plus 40 hours being worked for the week. I expect that the answer is that the Saturday work would not be considered overtime, although I am not sure.

Perhaps you should discuss this with a labor attorney in the state you live in. also, perhaps there is a forum on AllExperts where you could answer this question.
