Accounting, Payroll & Pension Issues - biweekly paydays

Expert: Shirley McAllister, CPP, PHR - 5/29/2009

Question
We get paid on the 15th and 30th of each month. Our employer states that if the last day of the month falls on a Sunday, we will get paid the next day, which of course is Monday. This doesn't seem right if Monday is the 1st of the next month. I thought you are to be paid on or before the last day of the month for biweekly paydays. Am I wrong?

Answer
If the payday falls on Sunday and the company is closed than you may be paid on the next business day. You must be paid every two weeks for biweekly.  If it falls on the first day of the next month because of Monday this will not be a big concern.

They cannot pay you on Sunday if they are not open, they also cannot send direct deposit on Sunday because the bank is closed.
