Accounting, Payroll & Pension Issues/All work and no pay

Question
Hi Shirley!

Recently I got a job for my cousin as a process server and file clerk for her business.  I've worked for her for about a year now with hardly any problems, until now. I've had to badger her in the past about a paycheck since I wasn't getting paid on time.

Now it has been a month and I haven't gotten paid! I have documented work hours, but she is so "busy" that she cannot get the check written out. Another cousin who works for the same business was able to write me a check once, but I have a feeling that it may not happen again.  How can I go about this if when I call her she just puts me to voice mail? I don't want to make a big scene during a family event. Any ideas how to go about this? I'm a non-employee as per taxes, so I don't get health/medical benefits.  Thanks!

Answer
You could send her a certified letter that she has to sign for and say that unless you are paid your wages you will have to file a complaint with the small claims court for unpaid wages. YOu can also file a claim with the Department of Labor.
