i live in ny and have a quadro for a divorce.can i also get child support & maintance arrears from his pension -4O1k and other retirement plan.? i need Help! i have tried garnishments and hes doin chapter 13 . Ex is doing everythin not 2 pay me.i haue O 2 hire lawyer 2 help me?
Unfortunately, you can only receive child support and maintenance from his pension and 401k if it was included in the QDRO.
If he is not paying you what he is supposed to pay, check with non profit organizations to see if they can help you. Do this before you go to the expense of hiring a lawyer.

I THOUGHT I READ THAT IF THERE IS ARREARS FOR CHILD AND MAINTANCE ARREARS THAT I CAN ATTACH WITH OR SEPERATE WITH THE QUADRO???BECAUSE EX HAS FILED BANKRUPTCY IT PUT A HOLD ON THE ARREARS WHICH IS ANOTHER STORY IN ITS SELF.HES TRYING TO DISCHARGE MY ARREARS AND MY EX LAWYERS LEGAL FEES. I FILED A OBJECTION BY MYSELF?? AND LAWYER FILED ADVERSAY PROCEEDING AGAINST HIM.WE WILL SEE WHAT HAPPENENS TOMORROW AND THEN SEE WHAT THE NEXT STEP IS. IAM IN FINANICIAL DISASTER AND HAVE TRIED TO DET LEGAL HELP BUT NO ONE WILL HELP ME.I TRIED THE VOL. LAWYERS IN MY AREA BUT SAID CANT HELP ME ???I GUESS ONLY MONEY TALKS AND IM TRYING TO SURVIVE WITH 2 KIDS..I HOPE JUSTICE WILL PREVAIL TOMORROW!!!!!THANKS FOR LETTING ME VENT | ||
