I am almost 100% sure that you cannot use the "Header" of the Master Page for the TOC.
You have to use the text in the body page to create your TOC.
Also you need to make sure the paragraphs you want to include have the same style name across each of the various chapters in the Framemaker Book, (i.e. if you use the style "Heading 1" for the first level of a document then you need to use apply the same style name for the first level in every document in your Frame Book.
Another example is if you have a Title on the first page of each of your files then they should all be named the same, (i.e not "Title" for some of the chapters and "TITLE" for other chapters. Framemaker "sees" "Title" and "TITLE" as different paragraph styles).
There is alot of information if you go the HELP on the Frame Menu Bar and just type TOC.
