Expert: Terrie Date: 3/8/2008 Subject: Father is illegal immigrant, expecting Mom is in prison
Question Our 21 yo daughter is in SD prison for parole violation. Discovered she was pregnant shortly after being sent back.
History of mental unstability & addictions, but wants to keep this baby of course. The father is illegal immigrant and has "moved on" from their relationship/denies responsibility.
Guess we're just looking for options/input, she is definitely not capable of raising this baby due in Oct, 2008. As her parents, we feel adoption is the best option for her and baby. Please any input would help. Thank you.
Answer Sadly this is not your choice to make but hers, even if she does have problems she still has every legal right to retain custody. What race is she and the birthfather> If she wants to place this child the father will have to be notitifed or if that is not possible after a lawyer tries to find him other ways of terminating his rights if need be that is if he cannot be found and she does wish to place have to be done by state laws. If she is in prison then she will need counseling etc. Would You want to adopt the baby if she were ok with that or become the childs legal guardians? Those are all possibles. Family members do have rights to temp custody if the state takes the child if she is still in jail when it is born if they have no on site facilities for children to remain with their mothers. Let me know if I can try to help more You need to talk to a lawyer. And your daughter. Best wishes
