Experience
I have 15 years of foster care and adoption experience as a clinical social worker. I have held many position in this arena including social worker, foster care and adoption trainer and homestudy coordinator, program supervisor and program director. I also have experiences with adoption in my personal life, as I have two adopted siblings and many foster siblings that I have kept in touch with over the years. I am passionate about this topic.

Question
I am a 19 year old female that attends school and also works.I no longer live with my parents,i have a roommate and although i am financially stable i do have money problems just like everyone else.I take care of my god daughter.she is 8 months old and i have had her with me since she was 2 months.although her mother is like family to me,she does not want the baby and but I'm afraid that the child father eventually will.Although we have no legal documents saying that I'm the care giver for the child is there anyway I can go about getting custody of the child without having to go to court to prove that her mother is not in the best interest of the child.I really don't want to cause trouble i just want to have the baby without having to worry that some day she will try and take the child back.do you think my age and situation will have a negative effect on what the court orders?

Hello Sharron,

If both parents voluntarily sign over custody to you, there will be no need to go to court to say that they are unfit.  That can be done in family court without termination of rights.  If you have been caring for the baby, taking her to her well child appointments in a timely manner, all immunizations are current etc. then your age and financial situation should not play a part.  

It is important to know that if you do not get legal custody, either parent or even the grandparents, could possibly try to obtain custody at any point.  It seems as though you are trying to do a good deed and want to provide a good home for a child, however, the law is the law and you need to pursue custody legally if you want any of the law's protections.  Hope that helps.
