Expert: Peter C. Winkler, CSW Date: 4/11/2008 Subject: resending parental rights post adoption
Question Mr. Winkler,
How do I go about resending our parental rights post adoption two years. We got her when she was 8mo.but she did not start having behavioral problems unitl 2yrs of age. We have a 4 yr. old that has Reactive Attachment Disorder, Bi-Polar, ADHD, and Oppositional Defiant Disorder. We did fost adopt through State Adoptions here in Calif. This child is destroying our family ( I have 4 other children), and my marriage. We do not have the resources, time, or money to give this child the help she needs.I have called three out lying counties for info. besides the county I live in. I have even asked post state adoptions for help and have gotten nowhere. Thank you for your time.
Answer Hi Julia-
I believe the legal term for what you want to do is to "abrogate" the adoption. However, it seems to me that your primary problem is getting an adoption agency to try to find another adoptive home for this child. Normally, the agency that originally placed the child for adoption with you, should work with you in order to find an alternative placement. I suggest that you widen your search to other California adoption agencies that might be able to help. If you contact enough people, I believe you will find someone who is willing to help with the problem. You might also contact the staff at the North American Council on Adoptable Children (www.nacac.org) to identify an agency or individual who can provide some help.
