Question
hi i have two little cousins one that is two and one soon to be one years old. they are in foster care in the state of north Carolina in Alamance county. i would love to adopt them but don't know if they are up for adoption yet. can i file a petition to adopt them ? is this a sure thing that i will be able to adopt them so that they do not go outside the family?

Hello Gabrielle,

I apologize for the delayed response.  To answer your question, yes you could file an adoption petition, but it may be somewhat premature if that is not yet established as the goal for them.  It would be important to speak with their parents, assigned social worker and/or assigned attorney to get a better idea of whether they are planning to reunite the children with their parents or not.  If not, filing an adoption petition would be a great way to try and ensure that they remain in your family.

Filing a petition, hpwever, does not guarantee that the adoption will go forth, you will still need to go through the homestudy process with clearances, references, etc.

I have not been published, but serve as the social work expert at the Kayla's Village ask the expert free on-line service. I have also presented at a national conference on foster care and adoption issues.

Education/Credentials
I have a Bachelor of Social Work from Howard University and a Master of Science in Social Work from Columbia University. I am clinically licensed in both Maryland and Washington, DC.
