We have been the sole carers of our 6 year old granddaughter since she was 4 months old can we adopt her an what is the process. We have the permission of our daughter who is her biological mother

Hello,

Thanks so much for your question.  You will need an attorney involved who can help you through the process.  I would call around locally and ask about rates as some will charge you a lot less than others.  Look for an attorney who specializes in Family Law.  It will depend on the state in which you reside but your daughter will need to sign consents to you and your spouse.  If the birthfather has been in your granddaughters life in any way may need to also sign away his rights.  If he has not been around, his rights will be dismissed by the court.  The court hearing can take place anywhere from manye 2 months up to 6 months after you petition the courts to adopt.  Our county tends to run about 5-6 months out.  Your attorney will help you with the adoption petition and you will be granted all rights to your granddaughter.

Don't forget you will qualify for an adoption tax credit (against all fees you may incur) on your taxes the next year.  Right now, the credit is a little over $13k.
