Question
I have a cousin who is about to be placed into foster care.  I would like to be his legal guardian/foster parent/adoptive parent. His grandmother is currently his legal guardian because his mother is on and off drugs and the court has stated that he cannot stay with his mother. Unfortunately, his grandmother does not want him with her anymore and is currently working with his mother to get him placed.  Should I wait until he is placed and then try to get custody or should I contact his social worker? Are there steps I should be taking to be proactive like background checks on myself(I live in PA)? I have my own house, single, no kids, don't drink or smoke, has never been arrested and has always kept a job.  Is there any reason why the courts might reject my petition?  Thank you!

Dear Shawn-
You didn't provide much information such as the age of the child, whether he also resides in PA and whether you have been in contact with him previously.  This information will help me answer your question. Do the grandmother and mother of the child know that you are willing to care for the child and if so, how do they feel about it?  I would encourage you to let them know that you are willing to care for the child and get their reactions and then get back to me with the additional information.
Yes, you may be able to become the child's guardian, but if you live in another state, the process may be more complicated and drawn out.  It would probably also be a good idea to contact the child's social worker after speaking with family members.
