Hi,

I was wondering how to go about having my present husband adopt my daughter. My daughter, her biological father and I are all Australian citizens. My daughter and I have been living in the US (Texas) for the last 3 years. Her biological father still lives in Australia and has never paid child support. I doubt her biological father would consent to the adoption. Can I get his parental rights terminated on the grounds he has never supported her?

Hi, thanks for writing.

My first and foremost thought for you is to: 1/consult with your regional embassy or consulate to find out exactly what your options are. As no one involved is a US citizen, I'm not sure how or if US law applies.

Depending on what your consulate tells you, my next step would be to consult with an attorney experienced in both US and Australian family law. Again, your consulate should be able to help you here.
