Subject: Legal Guardianship

Question
Hi Terrie, My husband and I are considering keeping our nephew for the next school year, as we learned his parents are unable to care for him in the near future. In order for us to admit the child to school or just take him to the doctors' office we need to obtain a legal guardianship. My question is how we obtain it? Should my brother in law get the form signed at the probate judge office, notarized? Should it be in his state? (as we live in 2 different states), or we need to get it done for him? We're confused who should get "the ball rolling". Can you advise?

Answer
Because this involves the laws of two states I would contact a good family lawyer that can find out the legalities invovled with both states. Is a parent willing to sign for gaurdianship? In my state temp is for an specific amount of time and or permanent so I would ask the specifics for your state. Best wishes
