Question
Hello Peter, I am wondering if you can answer a question, if not then that is okay.

Do you know what it takes for a step-father to adopt a step-daughter? Do we have to have the natural fathers' written consent? The natural father has not made contact with my daughter since Easter 2001...If you do not know the answer, I understand!

Melinda

Answer
Hi Melinda:
The easiest way for the step-father to adopt his stepdaughter is to get the birth father to sign a document relinquishing his  paternal rights.  The incentive for him is that he no longer will be responsible for child support.  If you can't get him to do this, you can still go to court and argue that he has not visited or made contact for over a year.  If he hasn't provided financial support that will also be considered.  A judge has to decide to terminate his parental rights, if he won't sign a relinquishment.
In order for the stepfather to adopt, you will need a lawyer to represent you and a social worker will have to visit your home and prepare an Adoption Home Study report.
