Experience
I am a social worker with an MSW and I have over thirty years of experience in family and children's services. I have worked as Director of adoption services and of the Interstate Compact in a large state agency. I have also provided direct services to children and families in a preventive services program. I currently prepare adoption studies for those who are adopting domestically or internationally.

Subject: adopting an adult stepchild

Question
I have been a stepmom for 20 years and I would like to legally adopt my stepson.  His biological mom is alive, but they haven't had any contact for over 22 years.  We live in Arizona.  Would it be possible for me to adopt my stepson without involving his bio mom?  He and his dad say she is a major pain and would probably make trouble just for the heck of it.  My stepson is 36.  

Answer
In a case where an adult is being adopted, I don't believe the court will require that the Mom do a surrender of parental rights.  Therefore, I don't believe she has to be contacted.  I think you should contact a local attorney or speak with the court clerk in the local court that does adoptions.
