Experience I have three adopted children. The two youngest were adopted as infants. In both cases, we dealt with the birthmother during her pregnancy and a bit afterwards. Our children are now old enough to begin asking questions and we are dealing with those issues.

Question Hello and thank you so much in advance for taking the time to answer my question and the questions of others in need of advice. My husband wishes to adopt my three year old daughter who is not his biologically. My husband and I do have a 10 month old baby together, but I'm not sure if that is relevant. Now I was not married when I had my daughter and her biological father is not a US citizen. He went back to Mexico and has never seen her or had any contact with her. His name does not appear on her birth certificate. So, my husband is wanting to adopt her but we have been told that the biological father must first give up his rights. How would that process even work, if we have no contact with him and he is in Mexico? We really want to get the process completed so that she will share our last name and be legally my husbands daughter. Any advice would be greatly appreciated.
Answer First of all, sorry it took so long to answer your question, but I was on vacation and forgot to note that in my profile.
I believe there is a way you can have your husband adopt your daughter by filing documents with the court stating that you have no knowledge of where the birth father is, and have had no contact with him since your daughter was born. You would really need to see an attorney about this because laws are different in every state.
