Subject: open adoption

Question
We have a situation in my town where a birth mother has been backed in the corner by the social worker and felt she had no choice but to sign termination of rights away. This social worker is very dishonest ( I know because I am a foster parent) the birth mom wants to do an open adoption with us and went and signed the form to reverse the termination (she had 90 days to do this and it had only been 1 week) now the big question how do we go about this so we can get this little girl to our home? Can mom do an open adoption with us?  

Answer
If the child is in foster care that is up to the caseworker and if she wants to take back her tpr they may not let her sign a new one to anyone. I am not a Lawyer just an adoptive mom that also was a foster mom. If mom did not want to sign her rights away what makes you think she will do so for You to take custody?  What state are you in? Is private adoption legal? Mom can always do an open adoption but not sure the caseworker is going to be Ok with that so much depends on the issues the state has with this mom now and in the past. Best wishes let me know how it all turns our. Is the baby in an adoptive home already at this time?
Have you thought about that this mom may do the same thing to you and take back the child and go back on her signing of rights? also where is the birthfather has he signed>

Note do you have an approved homestudy that approves You for Adoption? If not that could also be a problem.
