Question Dear Dan Pepper,
Is it a big deal in the industry to recycle the names of movies? I really want to start a series called Barely Legal, but the name has been taken by Hustler. What is the likelihood that I would be sued by them if used the name?
Answer Depending upon the success of the movie, magazine, or other content brand, you can certainly expect to attract some negative attention based on possible trademark infringement. I can almost assure you that Larry Flynt's attorneys will issue a nasty letter if you attempt to produce films under the Barely Legal moniker.
