QUESTION: I'm a little confused... I currently live in NJ and I've been thinking about starting a small production Company " home moives" but getting  real porn actress. But I keep hearing that C.A is the only state which allows porn to be produce in the US? If that's true is there anything that I can do in NJ?

ANSWER: Unfortunately, what you have heard is absolutely correct. California is indeed the ONLY place in the United States where the Production of Adult Films is actually legal.

I'm sure there are some companies who are producing Adult Films in NJ and many other States but rest assured those companies ARE NOT operating legally!

Adult film production is legal in California due to a precedent created by a 1988 decision of the California Supreme Court (California vs. Freeman). As a result of that decision, California became the FIRST AND ONLY state where a person can be legally hired to have sex for the purpose of making adult films. However, producers are still required to obtain permits before starting any such production. NO OTHER STATE HAS SUCH A PRECEDENT therefore production in any other State is, and will remain, ILLEGAL!

Anyone who tells you otherwise, is simply giving you bad advice.

QUESTION: What can i do to "get" into Porn.. would it also make it illegal if i go to C.A and film there and then do the processing and disttubtion of the films in NJ..

Answer
While doing all of your filming in California (with the proper permits) would be perfectly legal, you may still run into major legal problems when trying to distribute your material from a New Jersey location. The legality of such distribution will depend on the local City and State obscenity laws and the interpretation of those laws by local authorities.

I would STRONGLY advise you to speak with an Attorney who is highly experienced in Adult Industry Law before proceeding. PLEASE be sure that the Attorney you speak with is actually qualified to advise you on such matters.
