Adult Film - enforcabilty of contracts
Expert: Jim Boyd - 9/26/2008
Question I am doing research on the enforceability of adult entertainment contracts made between performers and filmmakers, the courts seem reluctant to enforce these contracts? is this a concern in the adult entertainment industry or is this not even true? What has your experience been like?
Answer I am unaware of any instance where a contract between a performer and a producer has been declared unenforceable or where a court has been reluctant to enforce the contact. As long as the contract was entered into in an area where the activities outlined in the contract are legal...then the contract will be legally binding on both parties.
In my experience I have only had one situation in which there was a contractual dispute with a performer. Because the contract was legal and binding, the judge promptly up-held the terms of the contract and ruled in my favor.
