Adult Film - Establishing Adult Studio in NYC

Expert: Dan Pepper - 10/12/2009

Question
Hello,
I was wondering if there were any specific legal issues for starting an Adult film studio in New York City. Are there any restrictions or issues to be addressed for the state or city of New York?
thanks,

Answer
There are no specific restrictions or issues unique for New York, except for compliance with the state'e obscenity laws (which you can read at http://www.moralityinmedia.org/nolc/index.htm?statutesIndex.htm), as well as the state's prostitution laws (http://prostitution.procon.org/viewbackgroundresource.asp?ResourceID=753#13).

Remember, only California has actual legal precedence for permitting production of adult content; no other state does so, so there is a heightened risk when producing content in New York.

You would be well advised to work with a qualified attorney in this area to assist you, since violating these laws can mean significant fines and jail time.
