Hi, I'm a photographer located on the gulf coast of Florida south of Tampa. My girlfriend is interested in becoming a dominatrix and I've created a web site for her.
The site isn't live yet. My question is can she have video clips produced in Florida by me on her site of performers who volunteer for the performance without pay. No sexual contact would be shown, just BDSM activities.
Even though no sexual contact is involved, due to the BDSM activities you still need to be concerned with applicable obscenity laws. Additionally, depending upon the specific nature of your content, the federal recordkeeping and labeling requirements of 18 USC 2257, 2257(a) and 28 CFR Part 75. The fact that you have performers acting without pay is ultimately irrelevant to these issues.
