Adult Film - adult website laws

Expert: Dan Pepper - 6/16/2009

Question
My wife and I were hoping to set up an adult web site with our home videos. We live in Arizona, it will just us, no one will be hired to perform. Is this legal in our state?

Answer
It depends.  Your content cannot be "obscene," which is a legal determination based, in part, on your local community standards.  You'll also need to comply with the federal recordkeeping and labeling requirements found at 18 U.S.C. 2257 and 28 CFR 75.  These are complicated regulations, and I would not recommend launching this business without qualified legal counsel.

Your website will also need appropriate terms and conditions, an adult content friendly web hosting company, and if you're be accepting credit cards on your site, you'll need a credit card processor that accepts sales of adult content.

You should also consider copyright registration for your content as well as your website itself.
